CAR CAVE EUROPE TERMS AND CONDITIONS OF USE

1. Acceptance of Terms 

These Terms and Conditions of Use (“Terms”) govern your access to and use of the websites operated by Car Cave’s European entities, including Car Cave Belgium, MIYO, and Car Cave Cyprus (each, and collectively, “Car Cave,” “we,” “us,” or “our”). By accessing or using these sites, you agree to be bound by these Terms. If you do not agree, please do not use the site. 

2. Who We Are 

These Terms apply to the following Car Cave entities, each responsible for its own site and market: 

• Car Cave Belgium 
• MIYO (Belgium) 
• Car Cave Cyprus 

References to “Car Cave” mean the entity responsible for the specific site you are using, as identified above. These entities are part of the Car Cave Global group. 

3. Description of Service 

Our sites allow visitors to browse vehicle listings, submit inquiries about listed vehicles, and subscribe to our newsletter. Our sites may in the future offer online payment or deposit functionality, which will be governed by additional terms presented at the time that functionality is enabled. 

4. Vehicle Listings — No Warranty of Accuracy 

Vehicle listings are provided for informational purposes and are compiled from information available to us at the time of publication, including from third-party sources, sellers, or consignors. While we make reasonable efforts to ensure listings are accurate, we do not warrant or guarantee the accuracy, completeness, or current availability of any listing, including pricing, specifications, condition, mileage, or history. All vehicles are subject to prior sale. You should independently verify all details, including through an in-person inspection and independent vehicle history report, before making any purchase decision. Nothing in this section limits any statutory conformity or consumer guarantee rights you have as a consumer under applicable Belgian, Cypriot, or EU law. 

5. Use of the Site 

You agree not to: 

• Use the site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the site, other accounts, or connected computer systems. 
• Scrape, harvest, or collect data from the site using automated means without our prior written consent. 
• Upload or transmit viruses, malware, or other harmful code. 
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity. ● Interfere with or disrupt the operation of the site or servers/networks connected to it. 

6. Inquiries and Communications 

When you submit an inquiry through our contact or listing forms, you consent to being contacted regarding your inquiry by email, phone, or other means you provide, on the basis described in our Privacy Policy. Newsletter subscriptions require your opt-in consent, and you may withdraw that consent and unsubscribe at any time using the link provided in each communication or by contacting us directly, in line with GDPR and applicable e-privacy rules. 

7. Online Payments and Deposits 

Where online payment or deposit functionality is enabled on our site(s), such payments will be processed by a third-party payment processor subject to that processor’s own terms. Payments and deposits are. Additional payment-specific terms will be presented and must be separately accepted at the time of any such transaction. As a consumer, you retain any applicable right of withdrawal under the EU Consumer Rights Directive where it applies to the transaction. 

8. Cookies and Tracking Technologies 

Our sites use cookies and similar technologies, including advertising and analytics tools. Non-essential cookies are only set with your prior opt-in consent via our cookie consent banner. Full details are set out in our Cookie Policy. 

9. Intellectual Property 

All content on our sites, including text, graphics, logos, images, and vehicle photography, is owned by or licensed to Car Cave and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our sites without our prior written consent, except as necessary for personal, non-commercial use in evaluating a vehicle listing. 

10. Third-Party Links and Services 

Our sites may contain links to third-party websites or services, including advertising, social media, and analytics platforms. We do not control and are not responsible for the content, privacy practices, or terms of third-party sites. Your use of such third-party services is at your own risk and subject to their respective terms. 

11. Disclaimer of Warranties

Our sites and their content are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law. We do not warrant that the site will be uninterrupted, error-free, or secure. This section does not exclude or limit any warranty or right that cannot be excluded or limited under applicable Belgian, Cypriot, or EU consumer protection law. 

12. Limitation of Liability 

To the extent permitted by applicable law, Car Cave and its affiliates, officers, employees, and agents shall not be liable for any indirect or consequential losses arising out of or in connection with your use of the site, any vehicle listing, or any transaction. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under mandatory Belgian, Cypriot, or EU law. 

13. Indemnification 

You agree to indemnify and hold harmless Car Cave and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the site, except where such claims arise from our own breach of applicable consumer protection law. 

14. Governing Law and Jurisdiction 

The governing law and venue depend on which Car Cave entity’s site you are using: 

• Car Cave Belgium / MIYO — governed by Belgian law, with disputes subject to the exclusive jurisdiction of the courts 
• Car Cave Cyprus — governed by the laws of the Republic of Cyprus, with disputes subject to the exclusive jurisdiction of the competent Cyprus courts. 

If you are a consumer resident in the EU, nothing in this section deprives you of the protection afforded by mandatory provisions of the law of your country of habitual residence, and you may also be entitled to bring proceedings before the courts of that country. EU consumers may also use the European Commission’s Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. 

15. Changes to These Terms 

We may revise these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the site after changes take effect constitutes acceptance of the revised Terms, subject to any additional notice required by applicable consumer protection law.
